Terms of Service

We visit a property under construction on agreed dates, capture 360° imagery and video of it, and host that record for you to view and share.

That is the whole of the service. In particular, see the next section.

A capture is documentation. It is a record of what a place looked like on a particular day, at a particular stage.

It is not an inspection. We are not home inspectors, engineers, architects or code officials, and nothing we deliver is a professional opinion that construction is correct, safe, complete or compliant with any building code or regulation.

Where a plan includes a written review, that review describes conditions visible in the imagery and points out what may be worth a closer look. It identifies potential concerns; it does not certify, approve or condemn anyone's work, and it is not a substitute for a qualified professional inspecting the property. If something in a capture looks like it warrants a professional's eyes, engage one.

We document what is accessible and safe to reach on the day of the visit. Areas that are blocked, unsafe, locked or not yet built will not appear in the record, and their absence is not a finding about them.

• Milestones are events, not dates. We capture when a stage actually happens, which on a real build is rarely when the schedule said it would.
• You are responsible for making sure we can lawfully get onto the site — that usually means the builder knowing we are coming and agreeing to it.
• If we arrive and cannot get access, or the stage has not been reached, we will reschedule. Repeated wasted visits may be chargeable, and we will tell you before charging for one.
• We follow site safety requirements. We will not enter somewhere we are told not to, or somewhere that looks unsafe.

Signing in works by a link emailed to you. Anyone with access to your email can therefore get into your account — keep it secure, and tell us straight away if you think someone else has.

Give us an email address you actually control, and keep it current.

Documentation is priced per home, as shown on the pricing page at the time you buy. Payment is arranged directly with us before the first capture visit.

If we have not yet captured anything and you change your mind, tell us and we will refund you. Once visits have happened, we will refund the portion we have not delivered.

You own your home. We own Xavier — the software, the website and the way the record is put together.

The imagery we capture of your property is yours to view, download and share for your own purposes, for as long as we host it. You give us permission to store, process and display it in order to provide the service to you, and for nothing else.

We will not use imagery of your home in marketing without asking you first and getting a yes.

You can share a walkthrough with anyone by sending them a link — family, an inspector, your lender, a contractor. Nothing is public and nothing is indexed by search engines.

But a link is a key. Anyone holding it can view the walkthrough and can pass it to someone else. Share accordingly.

We host your walkthroughs for the period stated on your plan, and we will tell you before that window closes so you can download what you want to keep.

We aim to keep Xavier available continuously, but no online service is perfect. We may occasionally take it offline for maintenance.

Don't use Xavier to break the law, to record a property you have no right to have documented, or to attack or interfere with the service or with other people's data.

We will do our work carefully and honestly. But because a capture is documentation rather than an inspection, we are not liable for construction defects, for decisions you or anyone else makes after looking at a walkthrough, or for anything a capture did not happen to show.

To the extent the law allows, our total liability to you is limited to what you paid us for the build in question. Nothing here limits liability that cannot lawfully be limited.

If we change these terms in a way that meaningfully affects you, we will tell you by email. The date at the top always reflects the current version.

These terms are governed by the laws of [governing jurisdiction to be confirmed before launch]. Xavier is operated by [legal entity name and registered address to be confirmed before launch].
